COUNTING OF APS SERVICE FOR TBOP/BCR

The Department has issued orders to count past adhoc services in APS as regular service for TBOP/BCR promotion.

Sub: - Counting of ad-hoc services rendered in Army Postal Service (APS) for the purpose of grant of financial upgradation under Time Bound One Promotion (TBOP) Scheme – Reg.

I am directed to refer to the references received regarding the issue of counting of ad-hoc services rendered in Army Postal Service (APS) for the purpose of grant of financial upgradation under Time Bound One Promotion (TBOP) Scheme introduced by the Department.

2. It is observed that the issue under reference was considered by the Hon’ble Supreme Court in C.A No. 5739 of 2005 in the case of UOI Vs Shri Mathivanan. The Apex Court in their judgment dated 09.06.2006 held that the official has completed 16 years of service (after taking into account his adhoc service rendered in APS) and would be entitled to the benefit of paragraph 1 of TBOP scheme and the action of the authorities in not granting the said benefit was illegal and contrary to law. Hon’ble Court observed that so far as placing of an officer in the next ‘higher grade’ is concerned, what was relevant and material was that such official belonging to basic grades in Group ‘C’ and D must have completed ‘sixteen years of service in that Grade’. They pointed out that it no where uses the connotation ‘regular’ service. It was also inter-alia observed “The scheme merely perused that any person having rendered 16/26 years of service without obtaining any promotion could be entitled to benefit therefore. It is, therefore, not a case where promotion to the higher post is to be made only on the basis of seniority.

3. In view of the dismissal of Civil Appeal No. 5739 of 2005-UOI & Ors Vs M. Mathivanan by the Hon’ble Supreme court on the above grounds vide their order dated 09.06.2006, the order dated 03.04.2002 of the Hon’ble CAT, Madras Bench pronounced in OA No. 1094 of 2001 was implemented subject to condition that the official will not be entitled to claim any seniority over those absorbed in the Postal Departmental before he was absorbed, for any purpose whatsoever.

4. It had been brought to the notice of the Directorate that a number of cases have been filed by the officials who have rendered adhoc service in APS seeking the benefit of above stated Apex court order in their cases also. The Department has considered the matter. Department of Personnel & Training and D/o Legal Affairs have also been consulted in the matter.

5. Keeping in view the Apex Court’s decision in M. Mathivanan’s case and the fact that TBOP is not to be granted on the basis of seniority. it has been decided with approval of competent authority to extend the benefit of the Apex Court’s order to similarly placed serving officials.

6. The TBOP scheme now stands withdrawn w.e.f. 01.09.2008 after introduction of Modified Career Progress Scheme (MACPS). It is, therefore, advised that all the cases of officials similar to the case of Shri. Mathivanan for grant of TBOP/BCR upto the period 31.08.2008 may be decided by counting the adhoc service rendered by them in APS.

GREAT ACHIEVEMENT WITHOUT SHOW OF STRIKE

DOP has restored 20% SUPERVISORY POSTS & 6% OPERATIVE POSTS. THIS IS GREAT ACHIEVEMENT WITHOUT SHOW OF STRIKE. THIS DEMAND IS PLACED BY SHRI M.K.KHAMBORKAR GENERAL SECRETARY BPEU CLASS-III. NO SUCH DEMAND PLACED BY NFPE AND FNPO UNION AS PER THEIR CHARTER OF DEMAND.

Consequent on implementation of time Bound One Promotion (TBOP) Scheme and Biennial Cadre Review (BCR) Scheme, Department of Posts had imposed cuts of 5% in operative staff and 15% in supervisory staff w.e.f 30.11.1983 under TBOP Scheme and later on, additional cuts of 1% in operative staff and 5% in supervisory staff were introduced w.e.f. 01.10.1991 under BCR Scheme. These cuts were introduced as measure of matching savings to offset the financial implications on account of grant of financial upgradations to staff and for obtaining additional productivity.

The said TBOP and BCR Schemes have now been withdrawn w.e.f 01.09.2008 consequent upon implementation of Modified Assured Career Progression Scheme (MACP). Consequently, the number of operative/supervisory posts existing as on 01.09.2008 will be taken into consideration for the purpose of periodical reviews or augmentation proposals of Post Offices establishment. Thus, provisions relating to reduction of staff under TBOP/BCR Schemes stand also withdrawn w.e.f 01.09.2008.”

RAISE IN DA FROM JULY 2010 WOULD BE @10% TOTAL DA WOULD BE 45%

All India Consumer Price Index Numbers for Industrial Workers on Base 2001=100 for The Month of June, 2010

All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of June, 2010 increased by 2 points and stood at 174 (one hundred and seventy four).

During June, 2010, the index recorded an increase of 8 points in Varanasi centre, 6 points each in Quilon and Giridih centres, 5 points in 4 centres, 4 points in 8 centres, 3 points in 13 centres, 2 points in 17 centres and 1 point in 19 centres. The index decreased by 1 point each in Ludhiana and Ghaziabad centres, while in the remaining 12 centres the index remained stationary.

The maximum increase of 8 points in Varanasi centre is mainly due to increase in the prices of Rice, Wheat, Fresh Milk, Onion, Vegetable and Fruit items, Electricity Charges, Bus Fare, Tailoring Charges, etc. The increase of 6 points in Quilon centre is due to increase in the prices of Rice, Fish Fresh, Onion, Vegetable and Fruit items, Cigarette, Tailoring Charges, etc. and in Giridih centres it is due to increase in the prices of Mustard Oil, Fish Fresh, Turmeric Powder, Vegetable and Fruit items, Soft Coke, etc. However, the decrease of 1 point each in Ludhiana and Ghaziabad centres is due to decrease in the prices of Onion, Vegetable items, Sugar, etc.

The point to point rate of inflation for the month of June, 2010 is 13.73% as compared to 13.91% in May, 2010.

Sir,
I am directed to refer to your letter no.Estt/M-377/34/GDS/Corr./2009/1 dated 24-06-2010, on the above mentioned subject.
2. The issue has been examined. DG Posts letter no.14-11/1988-PAP dated 16-07-1990 provided for payment of Rs.50 as combined duty allowance to GDS MD/MC who perform the work of EDBPM in addition to their normal charge of duties. It was also clarified that, GDS Mail Deliverer/Mail Carrier are not eligible for this Combined Duty Allowance if they perform duties other than that of GDS BPMs

3. As per the recommendations of One—man Committee and approved by the government, the GDS MD/MC attached with the addition duty of another Gramin Dak Sevak, revised rate of allowance will be at the rate of Rs.25 per day subject to a maximum of Rs.625 per month. Accordingly, the Mail Deliverer/Mail Carrier entrusted with the duties of BPMs in addition to their own work, are eligible for this additional remuneration as compensation. However, they will not be eligible for any Combined Duty Allowance which is now paid to Branch Postmasters towards delivery and conveyance work

To cite an illustration, if a Branch Post Office has one BPM and one GDS MD/MC on its establishment. In the event of GDS MD/MC performing the duties of Branch Postmasters in addition to his own, he will be eligible for a compensation of Rs.25 per day subject to a maximum of Rs.625 per month in addition to his normal Time Related Continuity Allowance. However, he will not be eligible for further Combined Duty Allowance paid to Branch Postmasters.

Sub: Implementation of Recommendations of Shri R.S. Nataraja Murti Committee.

Madam,
I am directed to refer to your letter no.Est/66-2/2009-dlg dated, 11-5-2010 on the above mentioned subject.

2 The points raised by the Circle have been examined and the following clarifications are provided.

Points on which clarification sought

1.Whether the benefit of fitment is admissible to Gramin Dak Sevaks officials whose scale of pay changed after 1-1-2006 due to transfer of redeployment. Similarly the above order is silent on protection of allowances

Position
The order dt. 9-10-2009 makes it clear for providing fitment at the time of fixation based on the TRCA drawn as on 1-1-2006 and it can not be applied to the GDS for change of pay scale after crucial date either due to transfer or redeployment. Such cases of fixation have to be guided by Dte letter no.14-16/2001-PAP (Pt) dt. 11-10-2004. Further, the OM dated 09-10-2009 is only about revision of TRCA and it has not revised or annulled the earlier order issued regarding protection of allowances in the case of reduction of workload or redeployment. The instructions issued in the letter no. 14-16/2001-PAP(Pt) dt.11-10-2004 are still in vogue and not Superseded or modified.

Points on which clarification sought
2.Prior to introduction of he above order GDS SPM/BPM doing mail conveyance are not entitled for combined duty allowance it the work is entrusted due to short fall n workload for justifying retention of Higher TRCA. Similarly, if the incumbent is working on protection of allowance they are not entitled to combined duty allowance. But the latest order is not clearly stated the position.

Position
The contention of the Circle appears to be not in order. The earlier order issued on 17-12-1998 provides that “the delivery and conveyance allowance to EDSPMs/EDBPMs who have been entrusted the additional work of conveyance of mails or delivery will be increased form the existing Rs.50 per month to Rs.75 per month. The flat rate of Rs.75 may be paid to all EDSPMs/EDBPMs to attend to conveyance/delivery or both.”

Therefore, payment of combined duty allowance is not connected to workload on account of delivery or conveyance or both. But the same is paid as compensation towards entrustment of additional work of conveyance/delivery or both. One—man Committee recommended revision of combined duty allowance to Branch Postmasters and separated conveyance work/delivery work and recommended payment of combined duty allowance for each item of work. Again, this was not related to workload of BPMs but towards entrustment of additional work of delivery/conveyance or both.

As per the order dated 11-10-2004, if the BPMs who is in a higher TRCA gets dropped in the workload, Combination of duties or mail delivery/mail conveyance has to be examined and to ensure that total workload of the post does not exceed 5 hours and in such cases only where the allowance is protected and additional work is given to him in such cases only combined duty allowance was not admissible.

However, One—man Committee recommended revision of combined duty allowance. This is applicable even in the cases of BPMs whose allowance has been protected and if they are doing conveyance/mail delivery work or both..

Points on which clarification sought
3. Kindly clarify whether GDS MDs are also entitled for combined duty allowance.
Position

In regard to clarification sought at item no. 4 of your letter, it is not clear whether he is exchanging mail with Account office or at an Intermediary office. The Circle is therefore requested for providing full details as to how a Branch Postmasters can make exchange in one way, and whether exchange is at a Bus stand or Railway station, or at Account office. The circle has to provide specific instances of four or five cases for further detailed examination.

Sub: Limited transfer facility to Gramin Dak Sevaks.

Sir/Madam,

I am directed to refer to this office letter no. of even dt 17-7-2006 on the above mentioned subject.

2. One-men Committee with Shri R.S. Nataraja Murti as Chairman, for examining Gramin Dak Sevaks system, studied the above issue and made recommendations in para 16.12.1 of the report.

3. The recommendations of the Committee were examined by the Department and after a careful consideration, the Competent Authority has ordered the following:

(i) All the five grounds stipulated for allowing the Transfer of Gramin Dak Sevak in para 2 of letter no. 19-10/2004-GDS dt. 17-7.2006 will be retained. The transfer facility can be availed by Gramin Dak Sevaks only once in whole career. However, an exception has been made for women Gramin Dak Sevaks, who availed the transfer facility on the ground of extreme hardship due to a disease and for medical attention/treatment before their marriage, can avail the facility for a second time in the event of their marriage/remarriage.
(ii) Past service of Gramin Dak Sevaks will be counted for the eligibility for appearing in the Departmental Examinations and for Ex-gratia gratuity and will rank junior in the seniority list of new unit.

(iii) However on transfer to a new post, the Gramin Dak Sevaks cannot have any claim for protection in their Time Related continuity Allowance drawn in the old Post. His/her Time Related Continuity Allowance will be fixed at the minimum of the Time Related Continuity Allowance slab of the transferred post, depending upon the work load of the aid post. In the case of Mail carrier/ Mail deliverer/packer, the work load has to be assessed on cycle beat. The transfer has to be approved only if the Gramin Dak Sevkas is willing for the new post, and an undertaking to the effect has be obtained and kept on record. This condition is provided to prevent the misuse of the limited transfer facility so that it can be availed only by those who genuinely need it.

4. All the other conditions laid down in letter no. 19-10/2004-GDS dt. 17.7.2006 will continue to apply.

5. The Heads of circle are requested to keep the above modifications in view while deciding the cases of transfer application of Gramin Dak Sevaks.

6. The contents may be communicated to all concerned for wide circulation amongst the Gramin Dak Sevaks in vernacular understanding.

Subject: Regulation of the Date of Next Increment in case of Extra-ordinary leave (without medical certificate) after implementation of the CCS(RP) Rules, 2008 -clarification regarding.


Consequent upon the implementation of CCS(RP) Rules 2008, the increments in the revised pay structure are to be regulated in terms of Rule 10 of the CCS (RP) Rules 2008. This rule states that 'there will be a uniform date of annual increment viz. 1" of July every year. Employees completing 6 months and above in the revised pay structure as on IsJu'ly will be eligible to be granted the increment."

2. The issue of regulation of date of next increment in case of EOL (without medical certificate) after implementation of CCS(RP) Rules 2008, has been examined in consultation with the Department of Expenditure.

3. It is clarified that except as provided under the conditions laid down in this Department's OM dated 18.2.1986, qualifying service of less than six months on account of EOL (without medical certificate) between 1July of the previous year till 30June of the year under consideration shall have the effect of postponing the increment to IsJu'l y of the next year. The same stipulation will also be applicable to those cases where the increment became due on 1.7.2006. In terms of this Department's O.M. No. 13017/20/85-Esn. (L) dated 18.2.1986, EOL granted for the following purposes automatically counts as qualifying service for pension and for increments without any further sanctions:-

Senior Superintendent of Posts, sentenced in a bribery case for three & half years rigorous imprisonment with a fine of Rs. 10,000/-

The Speical Judge, CBI, Ambala has convicted Sh. Dharam Pal Kherwa Senior Superintendent of Posts, Post office, Karnal for demanding and accepting a bribe of Rs. 10,000/- from the complainant. He was sentenced to undergo three & half years rigorous imprisonment with a fine of Rs. 10,000/-

A case was registered on the basis of a complaint against Sh. Dharam Pal Kherwa, Senior Superintendent of Posts and Ramesh Kumar, Office Supervisor of Post Office, Karnal under section 120-B IPC and section 7 of PC Act, 1988. The complainant was working as Postal Assistant at Post Office Patti Kalyana Distt. Panipat. It was alleged that they had demanded a bribe of Rs.10,000/- and a blanket from the complainant for his transfer from Patti Kalyana Distt. Panipat to Nilokheri, Distt. Karnal and also to cancel his dies-non period. On the Basis of the complaint, a trap was laid on 01.12.2006 by CBI and the accused were caught red handed while demanding and accepting the bribe of Rs. 10,000/- and a blanket.

After investigation, charge sheet U/s 120-B IPC r/w 7, 13(2)r/w 13(1)(d) of PC Act-1988 against both the accused persons was filed on 30.06.2007 in the court of Special Judge, Haryana, Ambala. Prosecution had cited 16 witnesses out of which 10 were examined after framing of charges. The Special Judge, CBI, Ambala (Haryana) convicted Sh. Dharam Pal Kherwa, Senior Superintendent of Posts, Post Office, Karnal and acquitted Sh. Ramesh Kumar office supervisor of Post Office, Karnal.

During May, 2010, the index recorded an increase of 6 points in Warrangal centre, 5 points in Guntur centre, 4 points in Chennai centre, 3 points in 16 centres, 2 points in 17 centres and 1 point in 18 centres. The index decreased by 2 points each in Yamunanagar, Puducherry, Amritsar, Ajmer, Ghaziabad and Varanasi centres and 1 point in 6 centres, while in the remaining 12 centres the index remained stationary.

The maximum increase of 6 points in Warrangal centre is mainly on account of increase in the prices of Moong Dal, Groundnut Oil, Eggs (Hen), Chillies Green, Vegetable and Fruit items, Bidi, Bus Fare, Repair Charges, etc. The increase of 5 points in Guntur centre is due to increase in the prices of Rice, Arhar Dal, Urd Dal, Goat Meat, Vegetable and Fruit items, Firewood, etc. and the increase of 4 points in Chennai centre is due to increase in the prices of Rice, Arhar Dal, Urd Dal, Eggs (Hen), Tamarind, Vegetable and Fruit items, Tea (Readymade), etc. However, the decrease of 2 points each in Yamunanagar, Puducherry, Amritsar, Ajmer, Ghaziabad and Varanasi centres is due to decrease in the prices of Rice, Wheat, Wheat Atta, Fish Fresh, Onion, Vegetable and Fruit items, etc.

The point to point rate of inflation for the month of May, 2010 is 13.91% as compared to 13.33% in April, 2010.

Postal Assistant sentenced in a CBI case

The Special Judge for CBI cases has sentenced Shri Bashir Ahmed Bhatt the then Postal Assistant, Gandhi Nagar Post Office, Jammu to undergo Rigorous Imprisonment for five years with a fine of Rs. 40,000/- in a fraud of Rs.1.73 Lakhs.

A case was registered in CBI Jammu on 13.08.1998 u/s 120-B, 420, 467, 468 RPC & Sec 5(2) r/w 5(1)(d) of J&K PC Act, 2006 against Shri Bashir Ahmed Bhatt, Postal Asst. Gandhi Nagar Post Office, Jammu, Shri Ujagar Singh Talwar, Asst. Post Master and Shri Ravinder Kumar (Private person) with the allegation that they committed a fraud of Rs 1.73 lacs during the period 1997-98 with public funds deposited in the post office.

Investigation revealed that Shri Bashir Ahmed Bhatt was Ledger Assistant (Saving Bank section) in HPO Ganghi Nagar Jammu. He entered into a criminal conspiracy with Shri Ujagar Singh Talwar & Shri Ravinder Kumar and got issued a cheque book in the name of account holder by forging her signatures on the application made for the release of cheque book. He withdrew an amount of Rs 1.73 lacs by forging the signatures of three a/c holders. Shri Bashir Bhatt made cuttings, insertions, alternations in the official record with the fraudulent intention to facilitate the withdrawal from the said accounts.

After investigation, charge sheet was filed in the court of Spl. Judge-CBI cases Jammu in March 2000 against the accused persons. After completion of the trial, accused Bashir Ahmed Bhatt was held guilty of offence U/s 120 & 409 RPC and 5(2) r/w 5(1) (d) of J&K PC Act 2006 and was convicted. The other two accused were acquitted by the court.

दलितों की अवस्था को सुधारने के लिए प्रयास तो गौतम बुद्ध के समय से ही शुरू हो गए थे. बुद्ध के बाद भारतीय समाज में कई संत और समाज सुधारक हुए हैं जिन्होंने दलितों की दीनदशा के लिए आंसू बहाए हैं लेकिन ज़मीनी कार्य पहली बार बाबासाहेब अम्बेडकर ने ही किया. उन्होंने यह क्रांतिकारी समझ दी कि दलितों को अपनी दशा खुद सुधारना होगी. किसी की दया पर उनकी हालत नहीं बदल सकती. इसलिए उन्हें शिक्षित होना पड़ेगा, संगठित होना पड़ेगा और नेतृत्व करना पड़ेगा.


डाक्टर भीमराव रामजी आंबेडकर ( 14 अप्रैल , 1891 -- 6 दिसंबर , 1956 ) एक भारतीय विधिवेत्ता थे। वे एक बहुजन राजनीतिक नेता, और एक बौद्ध पुनरुत्थानवादी होने के साथ साथ, भारतीय संविधान के मुख्य वास्तुकार भी थे। उन्हें दलितों के मसीहा ,महामानव , बाबासाहेब के नाम से भी जाना जाता है।

1. All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of February, 2010 decreased by 2 points and stood at 170 (one hundred and seventy).

2. During February, 2010, the index recorded a decrease of 5 points each in Sholapur, Ludhiana, Kodarma and Chhindwara centres, 4 points each in Ranchi Hatia and Jharia centres, 3 points in 14 centres, 2 points in 14 centres and 1 point in 17 centres. The index increased by 1 point in 6 centres, 2 points in 2 centres, 3 points each in Guwahati, Siliguri and Raniganj centres and 5 points in Labac Silchar centre, while in the remaining 15 centres the index remained stationary.

The maximum decrease of 5 points each in Sholapur, Ludhiana, Kodarma and Chhindwara centres is mainly on account of decrease in the prices of Rice, Wheat, Wheat Atta, Arhar Dal, Masur Dal, Groundnut Oil, Onion, Vegetable items, Sugar, etc. The decrease of 4 points each in Ranchi Hatia and Jharia centres is mainly due to decrease in the prices of Wheat, Wheat Atta, Arhar Dal, Masur Dal, Onion, Vegetable items, Sugar, etc. However, the increase of 5 points in Labac Silchar centre is mainly due to increase in the prices of Rice, Fish Fresh, Fish Dry, Potato, Tea Leaf, Pan Leaf, Firewood, etc. The increase of 3 points each in Guwahati, Siliguri and Raniganj centres is due to increase in the prices of Rice, Wheat Atta, Goat Meat, Poultry (Chicken), Milk, Pan Leaf, etc.
4. The indices in respect of the six major centres are as follows :
     Ahmedabad 164, Delhi 157, Bangalore 175, Kolkata 166, Chennai 157, Mumbai 168

5. The point to point rate of inflation for the month of February, 2010 is 14.86% as compared to 16.22% in January, 2010.

Release of additional installment of Dearness Allowance to Central Government employees and Dearness Relief to Pensioners due from 1.1.2010

The Union Cabinet today decided to release an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 1.1.2010 representing an increase of 8% over the existing rate of 27% of the Basic Pay/Pension, to compensate for price rise. The increase is in accordance with the accepted formula, which is based on the recommendations of the Sixth Central Pay Commission. The combined impact on the exchequer on account of both dearness allowance and dearness relief would be of the order of Rs.6969.36 crore per annum and Rs.8131.20 crore in the financial year 2010-2011 (for a period of 14 months from January, 2010 to February, 2011).

I am directed to intimate that instances have come to the notice of the Directorate that the officials posted as Sub-Postmasters in Town Sub Offices are being forced to occupy the staff quarters in the Postal Colony without actually applying for the same.

2. In this connection instruction/guidelines issued by this Directorate vide letter No.7-6/99-Bldg. (copy enclosed) dated 10/11/07.2000 on the subject mentioned above may kindly be referred to. As per the extant orders no Government accommodation can be thrust upon any Government Employee against his willingness and in the absence of a written request for allotment of a quarter from the employee. However, it is mandatory for the employee to occupy the post attached rent free accommodation wherever available. In such cases no HRA can be drawn in favour of the employee even if he is unable to occupy the rent free quarter.

3. It is, therefore, requested that the instructions/guidelines on the subject may kinldy be followed strictly.

Chief Post Master General of Maharashtra and Goa M.S. Bali Maharashtra-Goa official nabbed taking Rs.2 crore bribe

CBI arrests a Chief Post Master General and two middleman in a bribery of Rs. two crores
The Central Bureau of Investigation has arrested a Chief Postmaster General, (Maharashtra & Goa), GPO, Mumbai alongwith two private persons in a bribery case of Rs. two crores from the complainant.
It was alleged in the complaint that a bribe of Rs. two crores was demanded by the accused for giving NOC ( No Objection Certificate) from the Postal Department for development of plot of 2000 sq.mtrs, located in the jurisdiction of Mira – Bhayander Municipal Corporation, Thane. This plot of 2000 Sq.mtrs. was reserved for postal office for which the Corporation was requesting to issue NOC to develop the said plot as a private property with a slot to be kept for Post Office also. The complainant met the Chief Postmaster General in January, 2010 alongwith certain documents. The middleman contacted the complainant after this meeting with Chief Postmaster General and informed that he would help in getting the NOC from the postal department for the said plot.
The complainant alongwith the middleman met the Chief Postmaster General, where Rs. two crores was demanded for providing NOC.
The CBI laid a trap and the Chief Postmaster General was caught red handed while accepting bribe amount of Rs. 1.25 crores in a Restaurant located in Budhawar Park, Mumbai alongwith first middleman and another middleman. The rest of the amount Rs. 75 lakhs was to be taken by the middleman.
Searches were conducted in the office as well as residential premises of Chief Postmaster General and the middleman. During the search Rs. 34 lakhs ; 10722 US $ ; 3050 UK Pounds and 3470 Euros were found in the residence of Chief Postmaster General at Mumbai besides documents relating to immovable assets at Faridabad, Punchkula, Dwarka (in New Delhi), Bhopal and Gurgaon. The value of these assets is in crores. The accused is in possession of 22 Bank Accounts; PPF Accounts having a balance of more than Rs. 26 lakhs; 7 high-end Laptops belonging to Apple Viao; 45 imported Liquor bottles and two Cars. A locker in Gwalior is to be searched. All the three accused are being produced today in the designated court at Mumbai for remand.
Further investigation/ searches are continuing.

Against a Post Master and a Postal Assistant, Pallahat for entering into a criminal conspiracy and by abusing their official positions, fraudulently and dishonestly misappropriating an amount to the tune of Rs. 3.34 lac deposited by various SB and RD Account holders in their respective accounts, by posting false entries in the pass books with postal stamp impressions. Subject:- Compilation of information about appointments made on the basis of fake1 false caste certificates-Recommendation of the Parliamentary Committee on the Welfare of SC / ST.

The undersigned is directed to say that the Parliamentary Committee on the Welfare of Scheduled Castes and Scheduled Tribes in its Twenty-ninth Report (14'~ Lok Sabha) have recommended that the Department of Personnel and Training should collect information regularly from all Ministries1 Departments1 PSUsI Banks1 Autonomous Bodies1 States1 UTs in regard to cases of false caste certificates. The recommendation is reproduced below:

" ............DOP&T should interalia obtain information from all Ministries1 Departments, PSUs, banks, autonomous bodies and States1 UTs in regard to cases of false caste certificates regularly with a view to monitoring their progress and disposal, so that necessary plan of action could be taken to tackle the problem for good."


2. , This Department's O.M. No.1 1012/1191-Estt. (A) dated 19.5.1993 provides that if it is found that a Government servant had furnished false information or produced a false certificate in order to secure appointment, he should not be retained in service. Thus when an appointing authority comes to know that an employee had submitted a false1 fake caste certificate, it has to initiate action to remove or dismiss such an employee from service. All fhe Ministries1 Departments are requested to collect information from all Organisations under their administrative control about the cases where the candidates got/ alleged to have got appointment against vacancies reserved for SCs, STs and OBCs on the the basis of false1 fake caste certificate and send a consolidated report in this regard in the enclosed proforma to this Department latest by

DRAFT PRESS RELEASE

On or about 12th January 2010, an officer in the Income Tax department, Mumbai, noticed that refunds had been issued from his jurisdiction without his knowledge or approval of his higher authorities. He immediately brought the matter to the notice of his superior officers.

2. On internal inquiry by the Income Tax department, it was found that User Ids and Passwords of certain officers had been fraudulently used to generate refunds in some cases. Upon detection of the fraud, the following actions were taken by the Income Tax department to contain the damage:-

(i) Stop payment orders were issued. As a result, refund outgo in at least  two cases could be prevented.

(ii) Investigation and search action was undertaken by the Directorate of Income Tax (Investigation), Mumbai to detect the bank accounts to which the refunds had been credited and the beneficiaries.

(iii) I-T investigators have identified the bank accounts, beneficiaries and some of the scamsters involved.

(iv) Mumbai police and CBI Mumbai have been informed.
3. Further actions being taken to prevent the recurrence of such frauds are as follows:-

a) All high value refunds issued during the current financial year will be cross-verified.

b) The system of handling high value refunds will be replaced with a more robust and foolproof system.

Pension to Gramin Dak Sevak..... घडामोडी: ग्रामीण डाक सेवाकंच्या पेंशन विषयी ....

Gramin Dak Sevak shall not be entitled to pension as per the existing rules. The existing recruitment rules of Group-D and Postman provide absorption of GDS against regular departmental posts upto 50 years of age. therefore those GDS who complete 10 years of service are being entitled to pension. But most of the GDS are deprived due to not completing 10 years of service even 9 years 9 months also.  In order to get benefit of pesnion Department has power to relax the operation of any of these rules causes undue hardship in any particular case. Therefore DDG Estt. New Delhi has asked all CPMG /PMG to provide information in respect of all GDS appointed before 01/01/2004 vide his letter No 19-12/2009-GDS dated 18 Jan 2010

प्रचलित ग्रामीण डाक सेवक नियमावालीत ग्रामीण डाक सेवकाना पेंशन नाही. प्रचलित चतुर्थ श्रेणी आणि पोस्टमन भर्ती नियमावालीनुसार ग्रामीण डाक सेवकाना ५० वर्षा पर्यन्त खाते अंतर्न्गत सदर पदांमधील नियमित समवेशानंतर किमान १० वर्षे सेवा पूर्ण असल्यास (९ वर्षे आणि ९ महीने ) पेंशन मिळते. परन्तु काही ग्रामीण डाक सेवकांची १० वर्षे सेवा पूर्ण होत नाही किंबहुना ९ वर्षे आणि ९ महीने देखील पूर्ण होत नाही. अश्या ०१.०१.२००४ पूर्वी खात्यात नियमित समावेश असलेल्या ज्यांची ९ वर्षे आणि ९ महीने देखील पूर्ण होत नाही व पेंशनला मुकावे लागले आहे अश्या सर्व ग्रामीण डाक सेवकांची माहिती केंद्रीय आस्थापनाने पत्र क्रमांक १९-१२/२००९ - जीडीस दिनाक १८ जानेवारी २०१० द्वारे सर्व सी. पी. एम. जी. / पी. एम. जी. कडे मागीतली आहे.

AFTER SUCCESSIVE COURT CASES BY OUR UNIONS FINALLY THE DEPARTMENT OF POSTS IS FINALISING ANOTHER RE-VERIFICATION OF MEMBERSHIP UNDER CCS[RSA]RULES 1993 & ED [RA] RULES 1995.

AFTER SUCCESSIVE COURT CASES BY OUR UNIONS FINALLY THE DEPARTMENT OF POSTS IS FINALISING ANOTHER RE-VERIFICATION OF MEMBERSHIP UNDER CCS[RSA]RULES 1993 & ED [RA] RULES 1995.


Discussions are being held by Sh. Subhash Chandr (Director SR & Legal) with  BPEF Federations and all other Unions / Associations on finalizing the procedure for another re-verification.



This time, the Divisional Head will be the Check-Off and Re-verification Authority instead of DDOs as in the past occasions since the plea of our union that DDOs are union members of one of the unions and therefore they cannot be the Authority to verify the declaration forms of members was accepted by the Court and directions given accordingly.



The submission and verification of declarations etc procedure may end in the month of April and Recovery of subscriptions may be in the pay of May month. Exact Dates and Procedure would be published by us as soon as the DoP issues the orders for re-verification.

POSTMASTER CADRE CREATED ...............

DEPARTMENT ISSUED ORDERS FOR CREATING POSTMASTERS CADRE 


Total 2097 LSG Postmasters [POSTMASTER GRADE - I]; 511 HSG-II Postmasters [POSTMASTER GRADE - II]; 495 HSG-I Postmasters [POSTMASTER GRADE -III]; & 116 PSS GROUP -B POSTS [SENIOR POSTMASTER] HAVE BEEN DESIGNATED AS POSTMASTERS.

The Procedures to fill up these posts have not been spelt out in this order -But we gathered that the first time absorption in all these posts will be by one-time option from LSG - HSG-II -HSG-I officials. - But in future LSG Postmasters vacancies will be filled up only through competitive examination from PA/SAs.

D.A. hike to the extent of 8% w.e.f. 01.01.2010.

All India Consumer Price Index (industrial workers) Base 2001-100 for the month of December 2009 stands as 169 (i.e. one point rise from November 2009)

Therefore, the Central Government employees will have a D.A. hike to the extent of 8% w.e.f. 01.01.2010. The revised D.A w.e.f 01.01.2010 will be 35%. Normally the revised D.A rate will be approved by the cabinet and difference is being paid in the month of April every year.

Subject: Maintenance of records in consonance with Section 4 of the RTI Act

The Central lnformation Commission in a case has highlighted that the systematic failure in maintenance of records is resulting in supply of incomplete and misleading information and that such failure is due to the fact that the public authorities do not adhere to the mandate of Section 4(l)(a) of the RTI Act, which requires every public authority to maintain all its records duly catalogued and indexed in a manner and form which would facilitate the right to information. The Commission also pointed out that such a default could qualtfy for payment of compensation to the complainant. Section 19(8)(b) of the Act gives power to the Commission to require the concerned public authority to compensate the complainant for any loss or other detriment suffered.

2. Proper maintenance of records is vital for the success of the Right to lnformation Act but many public authorities have not paid due attention to the issue despite instructions issued by this Department. The undersigned is directed to request all the MinistrieslDepartments etc. to ensure that requirements of Section 4
of the Act in general and clause (a) of sub-section (1) thereof in particular are met by all the public authorities under them without any further delay.
