The Special Judge for CBI cases has sentenced Shri Bashir Ahmed Bhatt the then Postal Assistant, Gandhi Nagar Post Office, Jammu to undergo Rigorous Imprisonment for five years with a fine of Rs. 40,000/- in a fraud of Rs.1.73 Lakhs.
A case was registered in CBI Jammu on 13.08.1998 u/s 120-B, 420, 467, 468 RPC & Sec 5(2) r/w 5(1)(d) of J&K PC Act, 2006 against Shri Bashir Ahmed Bhatt, Postal Asst. Gandhi Nagar Post Office, Jammu, Shri Ujagar Singh Talwar, Asst. Post Master and Shri Ravinder Kumar (Private person) with the allegation that they committed a fraud of Rs 1.73 lacs during the period 1997-98 with public funds deposited in the post office.
Investigation revealed that Shri Bashir Ahmed Bhatt was Ledger Assistant (Saving Bank section) in HPO Ganghi Nagar Jammu. He entered into a criminal conspiracy with Shri Ujagar Singh Talwar & Shri Ravinder Kumar and got issued a cheque book in the name of account holder by forging her signatures on the application made for the release of cheque book. He withdrew an amount of Rs 1.73 lacs by forging the signatures of three a/c holders. Shri Bashir Bhatt made cuttings, insertions, alternations in the official record with the fraudulent intention to facilitate the withdrawal from the said accounts.
After investigation, charge sheet was filed in the court of Spl. Judge-CBI cases Jammu in March 2000 against the accused persons. After completion of the trial, accused Bashir Ahmed Bhatt was held guilty of offence U/s 120 & 409 RPC and 5(2) r/w 5(1) (d) of J&K PC Act 2006 and was convicted. The other two accused were acquitted by the court.
