Sub :- Launching of agititional programme for inviting attention of
Postal administration at lower formations to Postal Directorate Level on burning problems of postal employees in general, & Gr.C staff in particular.
Respected Madam,
As notified earlier, Central Working Committee meeting of this all India Union was held for a period from 15th Aug.2009 to 16th Aug 2009 at Chennai & discussed in length the burning problems being faced by Postal Employees particularly Gr.C.
In CWC it was resolved that to launch an agititional programme for inviting kind attention towards problems & its immediate redressal. The CWC further directed the General Secretary to appraise your honour with circumstances which led to take the decision for agititional approach. A very few of the problems are narrated as under:-
1) Violation of principle of natural justice for extending trade union facilities beyond date or expiry of recognition earlier granted.
As on date no union is recognized legally & status of all unions seeking recognition are as “applicant unions” but erstwhile recognized unions are enjoying all trade union facilities, this is the discrimination against other applicant unions.
2) Need to revival of redressal of grievances in time bound manner. It is said that “JUSTICE DELAYED IS JUSTICE DENIED” but it is observed that representations, appeals ,petitions preferred by individuals, unions are not being redressed or not at all redressed within a reasonable time hence there is dire need of revival for gearing up the revival mechanism at all formations.
3) Violation of established principle that “for the fault of administration poor employee should not be made to suffer”
Instances are being noticed in a big way wherein for the fault of administrative system/lapses/lacunas poor employees are made to suffer, this needs to be checked.
4) Harassment to “whistle blowers” against corruption.
Some authorities engaged in corruptive practices are misusing the powers which rest with them for harassing the whistle blowers .Higher authorities instead of safeguarding the whistle blowers either keeping mum or cover up the misdeeds of corrupts, this is not in the interest of the employees/administration/department & Nation. This needs to be checked with rigidity.
5) Dishonouring the judicial verdicts went in favour of employees by way of preferring appeals, SLPs etc. by incurring huge expenditure from public exchequer. Whenever any employee gets justice through the judicial system the administrative system takes it otherwise, with negative approach. Appeals/ SLPs are preferred by incurring heavy expenditure. A different approach is made from Circle to Circle.
6) Monitoring the system at the directorate level particularly with staff problems.
Directorate issues the instructions to the Circles particularly Promotional /Welfare policy regarding the staff. The Circles referred the matter for seeking clarifications on either this or that pretext. Directorate did not issue clarifications, in time. Different Circles took different view of the same order at their own leading to a total mess at the circle level.
7) Unfair labour practices while implementing project arrow, CBS & BD Schemes.
Authorities are not monitoring the shortage of staff equally in the operative/ administrative wing, and are keeping full strength in the administrative wing taking the personnel from the operative wing. This is highly irregular & should be checked.
8) Overlooking the provisions of CCS (CCA) rules for deciding the suspension cases & disciplinary proceedings.
CCS (CCA) are statutory rules having force of law & no deviation is permissible. The authorities are violating these rules while dealing with suspension cases where huge expenditure is involved. Similarly huge numbers of disciplinary cases are pending at all levels including the Postal Directorate. A punitive action needs to be evolved to curb such tendencies.
9) Making of subsidiary offenders for recovery of government loss in fraud cases.
It is observed that the inspecting officers, administrative authorities, though are responsible for facilitating the frauds due to negligence in duties but they are freed from the recoveries, entire loss is forced to be recovered from the Gr-C staff. This trend is increasing day by day resulting in ruining the families of Gr-C staff. This needs to be checked.
10) Modified ACP Scheme restoration of 6% feeder cadre & 20%
Supervisory staff strength.
Consequent upon the TBOP/BCR Scheme by introduction of MACP there is no need for curtailment of staff. Hence reduction of staff by 6% in feeder cadre &20% in supervisory cadre needs to be restored immediately. Similarly allowances for supervisory duties which were withdrawn also needs to be restored for effective supervisory mechanism, or granting grade pay to LSG grade pay of Rs 4600/-for 1st ACP/HSG-II (NB),Rs 4800/- for 2nd ACP & RS 5400/- for 3rd ACP/HSG-I should be given.
In view of the above foregoings for having a fruitful dialogue it is hereby requested to grant us a meeting to our delegation for discussing the problems in person. The details of the above problems in shape of note will be provided by the Union. The meeting may be fixed convenient to your goodself & enough time for us to submit the note. So that the confrontation between the administration & union can be avoided.

Dear Brothers,
“Namaskar”
After very long time I am meeting all of you through this special circular. Hope that everybody is well & fine. Considering the alarming situation on all fronts, an emergent CWC was called at Chennai on 15th & 16th August 2009. Discussions were held amongst CWC members in length on situations particularly on the following points………
1) Financial situation.
2) Legal battle.
3) Problems of staff & remedial actions.
4) Organisational review at all levels.
1) On financial matter, situation became from bad to worst. We could not pay rent electricity bills, telephone bills & water charges. Even our office secretary’s wages are due to be paid for number of months. No quota is coming from any quarter, our survival is at stakes. Those who have sacrificed for this organization with their TAN-MAN-DHAN are in tears. Hence it is unanimously decided to give a clarion call appeal to all Karyakartas to donate generously at least Rs 500/- Rupees Five Hundred Only to CHQ.It was also decided to make an appeal in local language by Circle Secretaries to all. Also decided that all office bearers of BPEU CLASS III should donate Rs 500/- to CHQ as considerable amount came in hands through 60% VI CPC arrears, Bonus, D.A. arrears, besides Modified ACP w.e.f. 01/09/2008 (10,20,30,years upgradation) in the next coming period. Circle Secretaries will ensure that this donation is collected & remitted to CHQ. They will also intimate the names & addresses of our pillar karyakartas to whom a personal appeal can be made by CHQ if need be. From these donations all liabilities will be cleared & for legal battles for getting equal status of facilities will be ensured.
Hence it is up to all of us to decide for keeping our organization alive in the interest of workers & department & nation.
2) On Legal Front we have filed a contempt petition against DG (Posts) by name. The same has been registered under no 950/2009.Progress of this petition can be reviewed by you on Internet at Chennai High Court Web Site. Hearing of this CP is expected at any time & after that by name notice will be served. After this a Writ will be filed for all trade union facilities. According to out senior advocate our case for contempt & writ for trade union facilities are fit cases with legal angle. Hon’ble High Court Jodhpur has stayed the declaration of results on half hazardly carried out membership verification. Hearing in Jodhpur is expected very soon. For legal battle a huge expenditure will have to be incurred. But we have no other ways. An appeal to collect funds is to be made. Collection of donations & its remittance are to be ensured by all of us.
3) Problems & remedial actions.
This issue was discussed in CWC & it was decided to launch an agitational programme as under
a) Divisional Level :- Demonstrations/Gate Meeting on 14th October 2009. (Originally fixed on 7th October in CWC but for preparation time later on decided by undersigned on 14th October or any other day if local situation compels so. Any change is to be intimated to CHQ)
b) Circle/Regional :- A day long Dharna in front of Regional/Circle offices on Wednesday the 11th November 2009.
c) Postal Dte. Level :- A week long Dharna at DAK BHAWAN starting from 7th December 2009.
Please ensure that the programme is made successful at all levels. A wide publicity is to be given. Posters, pamphlets , handbills are to be issued in local languages. Copy of the letter A/T The D.G. (Posts) along with notice & charter of demands are enclosed here with for ready reference. A memorandum highlighting the problems at the Divisional level along with charter of demand is to be submitted to the
Divisional Head. Similar action is to be taken at Region/Circle level by Regional/Circle Secretaries. The copies of memorandum so submitted to Division/Region/Circle level should be sent to CHQ for generalization. For Dharna at Directorate Level at New Delhi, further instructions will follow.

1 Adopt Principle of Natural Justice for extending trade union facilities to all applicant unions
2 Cause to stop harassment of members /activist /office bearers of BPEU Class-III at lower formations
3 Issue calendar for holding meetings of Departmental Promotion Committees by Postal Dte. for timely promotions at all levels
4 Restore the staff deduction of 6% in feeder cadre and 20% in Supervisory cadre, being implemented under TBOP / BCR Schemes, since 1/9/2008 i.e. from withdrawal of schemes
5 Redress the grievances of PO & RMS Accountant staff
(a) Cause uniformity for granting promotion to LSG (NB) cadre in Accounts line in all circles
(b) Grant special allowance to 1st MACP /TBOP & 2nd MACP/ BCR Accountants on the lines of treasures allowance
(C) Cause to count special allowance of PO & RMS Accountant for promotion to LSG (NB) for pay fixation
(d) Grant Notional promotion w.e.f.8/2/2002 to LSG NB Cadre in Accounts line to PO & RMS Account staff and further consequential promotions i. e. promotion to HSG-II /HSG-I notionally
(e) Stop harassment to account staff for recovery/refund in postman wrong fixation cases
6 Revive the machinery for redressal of grievances, individual/organizational in time bound manner at all levels.
7 Honour judicial verdicts delivered in favour of employees and withdraw the appeals, SLPs pending in High Courts/ Supreme Court
8 Absorb all applicants for compassionate appointments as one time measures and if needed in residual vacancies pending since 1999.
9 Cause to fill up all the posts in HSG-I , HSG-II, LSG (NB) in all circles by getting implemented postal Dte own orders on the subject
10 Cause to fill up all vacancies in PA cadre including resultant vacancies caused by granting promotions on Adhoc basis for year 2009
11 Stop staff deputation from operative group C staff to administrative wings causing further shortage of staff and create the cadres of system administrators, marketing executive & managers with higher grade pay, by promoting the existing staff
12 Grant higher Grade Pay to Supervisory Staff i.e. LSG (NB) Rs 4600/- HSG-II (NB) Rs 4800/- and HSG-I Rs 5400/-
13 Grant treasurers allowance at par with cash handling allowance as recommended in 5th & 6th CPCs
14 Instead of outsourcing, grant incentives/honourium to existing staff for additional works without capping on amount.
15 Settle all individual claims pending all over the country like TA, LTC, Medical bills, children educational allowance, OTA etc. within 3 months
16 Stop unfair labour practices while implementing Project Arrow, Core Banking Solutions & various BD Schemes.
17 Provide infrastructure i.e. well maintained computers and other gadgets, justified accommodation and staff, forms and stationery, proper furniture and working environment to cater efficient service to public.
18 Implement effectively various welfare schemes introduced by Govt of India for SC/ST employees, women, physically handicapped staff and redress their grievances in time bound manner and punish the authorities for not following the Govt policies.
19 Provide medical treatment facilities by nominating sufficient number of hospitals/labs etc in all locations at par with NCR Delhi
20 Appoint High Power Committee with assistance from outside investigating agencies for probing huge frauds involving corers of rupees, embezzlement of public money in franking machines, mail postings, by mailers, small saving scheme agents
21 Stop Harassment to “whistle blowers” against corruption and punish corrupt officials / officers
22 Stop making of subsidiary offenders for sole purpose of recovery of government loss in fraud cases and punish the disciplinary authorities for violating various provisions of CCS (CCA) Rules
23 Review all suspension cases within purview of amendments to suspension rules and recover the subsistence allowance paid unnecessarily from authorities violating the statutory rules.
24 Remove the anomalies arises due to the 6th CPCs recommendations causing injustice to Group C Staff
25 Remove injusticious provisions made in MACPs Scheme pertaining to Postal Gr-C staff
26 Adopt the principle in letter and sprit that “for the fault of administration poor employee should not be made to suffer” at all levels
